These Terms & Conditions govern the use of the Pro-Cabinetry website and the purchase of applicable cabinetry design, manufacturing, and installation services.

Important: This document is a draft for business use and requires legal review before publication. Policies in brackets must be completed and confirmed to reflect Pro-Cabinetry's actual business practices and applicable New Mexico law.

1. Services
Pro-Cabinetry provides custom design, manufacturing, and installation of kitchens, closets, cabinets, and related millwork for residential and commercial customers throughout New Mexico.
The exact scope of each project will be established in a written proposal, estimate, or signed agreement.

2. Estimates & Pricing
Estimates are based on the project details, dimensions, materials, finishes, and specifications available when the estimate is prepared.
Changes to the design, materials, dimensions, site conditions, or scope of work may affect the final price. Any applicable changes should be documented and approved in writing before the additional work proceeds.
Estimate validity period: 30 DAYS.

3. Design Approval & Custom Orders
Customers are responsible for reviewing and approving the final design, dimensions, finishes, materials, and specifications before manufacturing begins.
Custom products are made for specific projects. Changes requested after approval may affect pricing and delivery schedules and require written approval.
Design revision policy: Estimates are valid for 30 days. After that time all estimates are subject to rebidding. All are subject to on-site measurement verification before orders are processed. Any deviation or alteration from the stated specifications involving extra material or labor will become an extra charge over the stated estimate.

4. Deposits & Payment Terms
Required deposits, progress payments, and final payment terms will be provided in the applicable project agreement.
Deposit amount or percentage: 60% deposit due prior to commencement of work. 30% upon delivery. 10% after installation is completed.
Late payment policy: Pro-Cabinetry reserves the right to seek payment for overdue balances and to pursue any remedies available under applicable law. Any late fees, interest, or costs associated with collection will be charged only when permitted by applicable law and, where required, agreed to in writing..
Production, delivery, and installation may be subject to the payment requirements stated in the signed agreement and applicable law.

5. Measurements & Site Preparation
The project agreement will identify responsibility for measurements, site verification, preparation, access, and installation readiness.
Customers must communicate relevant site conditions and changes that could affect the project. Additional work resulting from unforeseen conditions may require a written change order and revised pricing.

6. Manufacturing, Delivery & Installation
Estimated production, delivery, and installation dates will be communicated in the project agreement or project updates.
Schedules may be affected by material availability, approved design changes, site readiness, transportation, or other unforeseen circumstances. Pro-Cabinetry will communicate material schedule changes when reasonably possible.
Installation is included only to the extent specified in the written proposal or agreement.
Delivery and installation scheduling policy: Upon delivery, the protection and safety of all cabinetry is the sole responsibility of the builder, contractor and/or homeowner. Pro-Cabinetry will not be held responsible for damage occurring to cabinetry on the jobsite by any party.
During or immediately following installation, cabinetry should be inspected for damage by the responsible party. Any damage found should be brought to Pro-Cabinetry's attention immediately.
To help protect cabinetry from damage, Pro-Cabinetry will leave protective packaging used during shipping for use by the responsible party.
If cabinetry is damaged after delivery, Pro-Cabinetry can provide touch-up and damage repair services. Pro-Cabinetry will strive to make repairs to finished cabinetry as invisible as possible, but perfection cannot be guaranteed. Repair services and replacement parts are billed separately and do not affect the final payment of the original invoice.
Small nicks, scratches, and minor damage can be repaired with touch-up kits. More severe damage may require replacement parts.
If cabinetry is damaged by Pro-Cabinetry during installation, Pro-Cabinetry will, at its discretion, repair or replace damaged components at no charge to the contractor or homeowner.

7. Cancellations, Returns & Refunds
Cancellation, return, and refund rights will be governed by the signed project agreement and applicable law.
Because custom cabinetry is manufactured for individual projects, cancellation or return options may differ from standard products. Any applicable fees, refund conditions, or restrictions must be disclosed before the order is confirmed.

8. Warranty & Workmanship
Any applicable product warranty or workmanship guarantee will be stated in the written project agreement.
Warranty duration and coverage: 1 year.
Warranty exclusions and claim procedure: 1-year manufacturer's warranty.
This limited warranty does not cover defects, damage, or failure caused by improper handling, cleaning, storage, assembly or disassembly, intentional damage, unauthorized product modifications or repairs, exposure to extreme humidity, moisture, or temperatures, accidental misuse, abuse, or negligence.
Natural woods may vary in texture, color, and grain. Wood joints may develop visible cracking around the joint area, and cabinet colors may darken or lighten over time.
Sunlight, smoke, moisture, household cleaners, and other environmental conditions may cause materials to vary, warp, split, or crack. These variations are not covered under this limited warranty.
Stained products are not warrantied for variations in color caused by natural variations in the grain, texture, and color of wood.
Nothing in these Terms & Conditions excludes consumer rights or other protections that cannot legally be waived.

9. Materials, Colors & Natural Variations
Images and samples illustrate product appearance. Actual colors may vary due to lighting, display settings, material batches, and natural variations in wood or other materials.
Customers should review applicable samples and specifications before approving production.

10. Customer Responsibilities
Customers are responsible for accurate project information, reviewing and approving designs, arranging site access, and meeting agreed payment and preparation obligations.
Any additional responsibilities will be specified in the project agreement.

11. Website Content & Intellectual Property
Website text, photographs, logos, designs, and other content owned by Pro-Cabinetry may not be reproduced or used commercially without authorization, except as permitted by law.
Project-specific drawings and design ownership or usage rights will be addressed in the applicable agreement.

12. Limitation of Liability
Any limitation of liability must comply with applicable law. Nothing in these Terms & Conditions limits liability where legally prohibited.
Legal review required: Confirm appropriate liability language for residential and commercial projects in New Mexico.

13. Privacy & Personal Information
Information submitted through the website, email, telephone, or other contact channels will be handled according to Pro-Cabinetry's privacy practices and applicable legal requirements.

14. Governing Law & Disputes
These Terms & Conditions are subject to applicable law.
Legal review required: Specify governing law, venue, and dispute-resolution procedures after review by a qualified attorney familiar with New Mexico law.

15. Changes to These Terms
Pro-Cabinetry may update these Terms & Conditions when necessary. The effective date will be updated when revisions are published. Changes to an existing project will also be subject to the applicable signed agreement and law.
